Alohi’s provision of SIGN.PLUS is conditioned on your acknowledgement of, and agreement to the below terms as well as Alohi Terms of Service (https://www.alohi.com/terms-service/). Unless otherwise defined in these Product-Specific Terms, capitalized terms will have the meaning given to them in the Alohi Terms of Service (found at https://www.alohi.com/terms-service/) and Privacy Policy (found at https://www.alohi.com/privacy-policy/).
1.1. Product description. SIGN.PLUS is a legally binding electronic signature platform that allows customers to sign documents electronically online as well as send out documents for signature (“SIGN.PLUS Services”).
2.1. SIGN.PLUS use. To use SIGN.PLUS Services you must either have an Account or have received a request for signature in your email account by a user.
2.2. Electronic signature responsibilities. Electronic signatures and electronic records may be subject to specific regulations determined by government agencies around the world. We are not responsible or liable to determine whether any of our users signed documents are subject to any exceptions to applicable electronic laws or are legally viable to be processed with electronic signature. To find out whether your document is subject to specific regulations around the world, consult your organization’s legal counsel or your legal representative.
2.3. Audit trails. A digital audit trail records all activities in connection with the electronic documents signed using SIGN.PLUS Services. The audit trail records information concerning the status of the document at each stage of the signing process, for both the sender and the recipient(s). The activities recorded include, but are not limited to, date and timestamps, name, email address, IP address and electronic document action taken (created, viewed, signed).
2.4. Identity verification. Certain transactions will require an identity verification. We use third-party service providers (“Service Providers”) to carry out the identification processes. We are not responsible or liable for the processes used for identification by the Service Providers. All data provided by you must be accurate to ensure correct results. We are not responsible or liable if the Service Providers are unable to verify your identity and consequently unable to sign the electronic document or if the Service Provider incorrectly identifies and verifies another recipient and allows them to sign the electronic document.
3.1. Retention of signed electronic documents by the user. The retention periods of any electronic documents signed using SIGN.PLUS Services are determined by the user and are subject to applicable laws. We are not responsible to determine the length of the retention periods for which electronic documents are stored by the users. 3.2. Electronic document transmission and storage. We will store and send the electronic documents in accordance with respective Subscription Plans. During your Subscription Term, you may download copies of electronic documents for storage. However, we reserve the right to prevent or stop any usage of SIGN.PLUS Services that appears to be abusive or is unduly burdensome and set limits for reasonable use.
3.3. Uncompleted electronic documents sent out for signature. Uncompleted electronic documents, which have been sent out for signature, may be deleted without notice, at our sole discretion, (i) upon the expiration of the envelope (where such an expiration has been set) (ii) upon the expiration of the Subscription Terms. We are not liable or responsible for the failure of a party to electronically sign the electronic documents within the given timeframes.
4.1. Pricing policy. Subscription Plans contain signature requests that are included in each plan. If you want to send and/or receive more signatures than are included in your Subscription Plan, you will need to upgrade your Subscription Plan. We may change the prices for or alter the features and options in a particular Subscription Plan without notice.
4.2. Unused Subscription Plan items. The amount of signatures included in your Subscription Plan is valid only for a one-month period and does not roll over to the next month.
5.1. Cooling-off period and refund policy. When you purchase a Subscription Plan or perform any purchase directly from us you will be entitled to a cancellation period of 24 hours (“Cooling-Off Period”) unless you have made use of the purchased item or plan in any way, in which case the Cooling-Off Period will be extinguished and your purchase cannot be canceled or refunded. Outside of the Cooling-Off Period, nothing is refundable.
5.2. Cooling-off period limitations. The Cooling-Off Period and refunds do not apply to payments made that are (i) purchased via our third party partner (please contact the partner directly, who may decide, at its sole discretion, whether or not to pay a refund), (ii) not directly acquired online from us (e.g. vouchers or pre-paid cards) (iii) paid for in cash using third party payment methods (such as a cash payment wallet) and (iv) paid for and allocated to your Account by a manager, administrator or another user.
5.3. Misuse. We reserve the right to refuse a refund request if we reasonably believe (i) that you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same Alohi Service; (ii) if you are in breach of Alohi Terms or (iii) if we reasonably suspect that you are using Alohi Services fraudulently or that your Account is being used by a third party fraudulently.
6.1. Free trial. You may be provided with a free trial of SIGN.PLUS Services for a period of 14 days for a Subscription Plan of your choice. The free trial may have reduced access to features of SIGN.PLUS Services. The Alohi Terms apply throughout the free trial.
6.2. Expiration of the free trial. During the registration for a free trial of SIGN.PLUS Services, you will be asked to provide your payment method. Upon the expiration of the 14 day trial period, your chosen Subscription Plan will automatically be due. You acknowledge that you will not receive a notice from us that your 14 day trial has ended and that payment for your chosen Subscription Plan is due. You can upgrade your free trial to a paid Subscription Plan of your choice at any time during the 14 day trial period. Unless you purchase a Subscription Plan that is equivalent or higher than that covered by the free trial, all the data entered during the trial period will be permanently lost upon the expiration of the trial period. We reserve the right to reduce or cancel the free trial period without prior notice.
6.3. Cancellation of a free trial. If you wish to cancel your paid free trial before the expiration period ends, you may do so via your “Profile > Plan & Billing” page.
